A Binding Agreement

Welcome to Petsupplies.pk (the “Site”). These Terms and Conditions (“Terms”) constitute a legally binding agreement between you, the user and customer (“you,” “User,” or “Customer”), and Petsupplies.pk (the “Company,” “we,” “us,” or “our”). By accessing, browsing, or utilizing this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you are expressly prohibited from using the Site and must cease use immediately.

1. User Account and Responsibilities

1.1 Eligibility and Registration

By using the Site, you represent and warrant that you are at least eighteen (18) years of age and possess the legal capacity to enter into this agreement. If you create an account, you are obligated to provide current, complete, and accurate registration information.

1.2 Account Security

You are entirely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

2. Products, Orders, and Pricing

2.1 Product Availability and Descriptions

We strive to ensure that all product descriptions, pricing, and availability are accurate. However, we do not warrant that product descriptions or other content of the Site are complete, current, or error-free. The inclusion of any products on the Site does not guarantee that these products will be available at the time of your order. All prices are subject to change without prior notice.

2.2 Order Acceptance

Your placement of an order does not automatically constitute our acceptance of that order. We reserve the right at any time after receipt of your order to accept or decline the order for any reason, including but not limited to product availability, error in the price or description, or suspicion of fraudulent activity. The contract of sale is finalized and acceptance is confirmed only upon the shipment of the products to you.

2.3 Payment

All payments must be made in Pakistani Rupees (PKR). You agree to provide us with current, complete, and accurate purchase and account information for all purchases made via the Site. We employ secure third-party payment processors; we do not store sensitive payment card details.

3. Shipping, Delivery, and Risk of Loss

3.1 Shipping Fees and Timelines

Shipping fees and delivery estimates are specified at the time of checkout. These timelines are estimates only and are not guaranteed. We are not liable for any delays in shipping or delivery caused by the courier service or unforeseen circumstances (Force Majeure).

3.2 Risk of Loss

All items purchased from the Site are made pursuant to a shipment contract. The risk of loss and title for such items pass to you upon our delivery to the carrier (shipping company).

4. Returns, Exchanges, and Refunds

Our policy on returns and exchanges is detailed separately on the Site, which is incorporated into these Terms by reference. Generally:

Defective or Damaged Goods: Claims must be reported within 3 days of receipt.
Non-Returnable Items: Perishable goods, opened food items, and personalized products are typically exempt from return unless defective.
Refunds: Refunds, where applicable, will be processed to the original payment method or as store credit within a reasonable timeframe following inspection of the returned goods.

5. Intellectual Property Rights

All content on the Site, including text, graphics, logos, images, digital downloads, and software, is the property of Petsupplies.pk or its content suppliers and is protected by Pakistani and international copyright laws. Unauthorized use, reproduction, or distribution of any materials from the Site is strictly prohibited and constitutes a material breach of these Terms.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Petsupplies.pk and its affiliates, directors, officers, employees, agents, or licensors shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site; (ii) any conduct or content of any third party on the Site; (iii) any products purchased through the Site.

7. Governing Law and Jurisdiction

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict of law principles. Any legal action or proceeding related to the Site shall be brought exclusively in the courts located in Lahore.

8. Amendments

We reserve the right, at our sole discretion, to revise and update these Terms at any time. The updated version will be effective immediately upon posting. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.
